About the Speakers

Joyce Deuley: As an IoT analyst and content strategist, Joyce has spent the better part of the last five years examining IoT market trends, challenges and opportunities, and sharing the impact of what the IoT has to offer. Currently, Joyce is the Founder & CEO of a Texas-based, state-wide non-profit, the Smart Texas Alliance,  that is looking to promote and elevate the IoT community in order to make Texas a “Smart State” via education, partnership development, and community engagement.

Kurt Kelley: As CEO of his Technology Consultancy, Kurt specializes in developing relationships between carriers, re-sellers, and industry leading technology providers globally to solve real business challenges. Before founding Excelerated he served in multiple capacities at Verizon, and most recently Stream Technologies where he was responsible for managing the IoT re-sellers and vertical solution providers. With over twenty years of technology experience there is rarely a problem he is unable to organize an end to end solution for.

IoT Business Reality & Patent Development

I. IoT Business Reality

Goldman Sachs defines the IoT (Internet of Things) as the third wave of internet revolution: by connecting to the internet billions of devices, the IoT opens up a host of new business opportunities and challenges. According to McKinsey, the IoT has the potential to create up to $6 trillion economic value annually by 2025. The IoT has various applications including, smart homes, connected cars, smart grids, smart healthcares, smart businesses and smart cities. Many players across diverse industries including semiconductor, consumer electronics, ICT, healthcare, retail, industrial & manufacturing and transportation are participated in the IoT business. Recently, many global leaders in the IoT business provide the IoT platforms to create diverse platform-based business models and form the IoT business ecosystem. According to the market research of Research and Markets, there are more than 2000 companies (including 260 companies that are offering IoT platforms) that are selling IoT enabled products, playing a vital part in the IoT technology infrastructure, or act as an enabler to the IoT development. The IoT business reality can be summarized as follows.

·         The IoT business will follow either evolutionary or revolutionary development step depending on the innovation characteristics of the building blocks of the IoT - IoT devices: Devices that can sense/recognize their surrounding environments and communicate with other devices; Networks: Connecting/communicating  medium/infrastructure that can interconnect devices and connect devices to the internet; IT systems: Back-end or embedded systems that can process information (data) obtained by the IoT devices (e.g. cloud computing/big data analytics) and provide the value added services exploiting the information.

·         A few major companies will not dominate the growth of the IoT market. Rather, virtually all of business ecosystem players will involved in creating and developing the IoT market.

·         It will take some time to reach the fully gown IoT market. The IoT product/service will keep making life richer, safer and more comfortable and work easier, more productive and more efficient.

·         The IoT business will be interdisciplinary across many industries. The IoT business will have synergies by the convergence of many different technologies or business attributes. The IoT business can create entirely new industries providing dramatically different values to the customers.

II. Patent Development Strategy for the IoT Business Reality

The development of patents (drafting for new applications, creating value through prosecution and strategic patent portfolio development) regarding IoT innovation should consider the IoT business reality. Especially, the IoT patent development should support future development of IoT businesses and commercial implementations of IoT innovations. Additionally, the IoT patent development should support for both ecosystem players’ exploitation and customers’ use of the IoT innovation. To take care of the tasks of the IoT patent development in alignment with the IoT business reality, the system approach to the IoT patent can be applied.

The disclosures of the IoT patent can be considered as a system that is consist of several subsystems: environmental context, IoT sensor, information, transfer mean and processing tool.

·         Environmental context is the context of the surrounding object(s) sensed by the IoT sensor.

·         IoT sensor is a stand-alone or embedded device that can sense/recognize its surrounding environments (including position/movement/identification) with networking capability.

·         Information is the context data obtained by the IoT sensor for specific purpose.

·         Transfer mean is the networking/communicating medium/infrastructure that can interconnect sensing devices and connect sensing devices to the internet.

·         Processing tool the back-end or embedded IT systems/processors that can process the context information (e.g. cloud computing/big data analytics) and provide the value propositions exploiting the information.


Following figure illustrates the IoT Patent system.

Then, the system as a whole and each system can be construed to support future development of IoT businesses and commercial implementations of IoT innovations.

Samsung IoT Strategy & Patent Exploitation

I. Samsung IoT Business Strategy

Recently, several S. Korea’s news media expressed their concerns regarding the future of Samsung IoT business. The concerns are based on KT (Korea Telecom)’s recent research report “Smart Home Trends & Implications.” The report doubted Samsung’s capability to drive successful Smart Home business, which is the key IoT (Internet of Things) business of Samsung. The report reasoned that, because Samsung has never been successful in the platform business, Samsung may lack in execution capability to become the winner in the IoT platform wars, and thus, in the emerging IoT market. Rather, the report expected that Apple and Google will lead the future Smart Home market because of their core confidence in platform based SW/IT integration.

In response to the concerns, Asiatoday, a S. Korean newspaper, expressed a different view about the Samsung’s future of IoT business.  Quoting personal discussion with Samsung executives, Asiatoday said that Samsung has never derived the IoT as a main business up to now because the lack of business reality of the IoT market. Rather, Samsung is at the stage of preparing IoT business by focusing on R&D and business ecosystem development. Asiatoday also mentioned that the “Fast Follower Strategy” that Samsung has several success track records will also work in the emerging IoT/Smart Home market because of its HW integration capability across chips, devices, networks and appliances, which are the key business resources for offering new values to customers.

Actually, Samsung has just started to derive the IoT business by providing the open IoT platforms and intensifying relationship with the IoT business ecosystem collaborators. Samsung released the IoT platform “Artic,” an open platform comprised of hardware modules, software, networking and cloud services, in May.  Samsung also recently introduced a Web based platform, IoT.js, to provide interoperable service platform. SmartThings, acquired by Samsung last year, announced the SmartThings Open Cloud, a cloud service. Samsung is fostering its collaboration relationship with innovative IoT start-ups through the Samsung Strategy and Innovation Center in Silicon Valley.


In addition to the efforts to have a leadership in the IoT business ecosystem, Samsung also need to make efforts to form the IoT customer ecosystem. The “First Mover” advantage and the business ecosystem integration capabilities are not the only key success factors that made Apple as the winner in the smartphone market. Keep innovating to offer values to customers and always satisfy customers’ expectations, and thus, to form the Apple fan club and enthusiasts, is the most important success factor. Therefore, to become the winner in the emerging IoT market, Samsung also need to do its best to offer new values to customers and form the Samsung customer communities for customers’ satisfaction and meeting the expectations by orchestrating its IoT business architecture. Following figure illustrates Samsung’s IoT business architecture to orchestrate.


II. Patent Exploitation for Samsung IoT Business Strategy

Samsung is the 2nd largest patent holder in the US (4,952 issued patents in 2014) and the 1st largest patent holder in Europe (2,541 issued patents in 2014). Thus, patents can be a very important business resource to exploit for developing the Samsung IoT business leadership. For example, Samsung patents can be exploited for the development of the disruptive IoT products/services by opening patents to the business ecosystem collaborators in diverse industries (the “Open IP Innovation”). By letting the collaborators develop the disruptive IoT products/services exploiting Samsung patents, Samsung can keep focusing on the current mainstream market in addition to effectively prepare the emerging IoT market created by the disruptive IoT innovation.

Recently, Samsung opened its 38,000 patents in various fields including telecommunication, semiconductor and display to S. Korean SMEs and venture companies as the part of the creative economy innovation center project. Total of 3,000 patents will be provided for free. Samsung will send its patent experts to the center to help exploiting its patents by the selected members of the center. Samsung will need to extend the Open IP Innovation program to its global IoT ecosystem collaborators for developing the disruptive IoT products/services.

A smart and practical method to exploit patents for the development of the disruptive IoT products/services through the Open IP Innovation is to apply the new product/service development methodology in the “Blue Ocean Strategy” (the “Blue Ocean Patent Strategy”). The basic principle in the Blue Ocean Patent Strategy is to exploit patents to achieve the value innovation by using the patented technologies to create new values, and thus, to provide new products/services. The exploitation of existing patented technologies not only allows the low cost IoT product/service development but also provides the protection against competitors’ infringement.

IoT Ecosystem & Patent Strategy


I. IoT Business Ecosystem

A business ecosystem is the community of business entities that is formed by the competitive and collaborative interactions among business entities for new innovations. A business ecosystem evolves to form a new value network, and thus, to create a new market. The key building blocks of a business ecosystem are the platform providers and value creators. A platform provider develops a platform, which is a collection of core technologies/solutions with open interfaces for interaction with the value creators. A value creator creates values by exploiting the platform.

Many market researchers expect that the interconnected IoT (Internet of Things) devices will create a new market that will result in more than $1 trillion in value added to the global economy within 10 years. Recently, many global leaders in IoT business provide the IoT platforms to create diverse platform-based business models and form the IoT business ecosystem. According to the market research of Research and Markets, there are more than 260 companies that are offering IoT platforms. Some of the IoT platforms are as follows.

·         Samsung Artik platform can help developers create new sensor-enabled devices. Artik platform includes a family of processors and wireless connectivity that can power and connect everything such as servers, smartphones and wearables (https://www.artik.io/).

·         Apple HomeKit home automation platform can help developers create new securely connected home automation devices in iOS.  HomeKit enables users to discover HomeKit accessories in their home and configure them, or create actions to control the devices (https://developer.apple.com/homekit/).

·         Qualcomm AllPlay Smart Media Platform allows simple wireless connectivity to individual speakers or an entire home audio system over the user's existing home WiFi network (https://www.qualcomm.com/products/allplay/platform).

·         Google Brillo platform will help developers create connected home environment.

The number of competing IoT platforms is likely to increase for a certain period of time, and then, merge into several dominant IoT platforms through the IoT platform wars, which means the super-competition to form a cluster with value creators at some market positions in the evolved IoT ecosystem. The cluster of a platform will be complex because of participation of diverse ecosystem players across several different industries. Following figure illustrates the clustering of a platform with value creators across the smart home and connected car industry.


II. Patent Strategy for the IoT Business Ecosystem

The patent strategy for the IoT ecosystem should be in alignment with the evolution of the IoT ecosystems initialed by the dynamic reconstruction of value networks through the IoT platform wars. Most of all, the patent strategy for the IoT ecosystem should support the essential features of the dominant design IoT platforms for the IoT ecosystem: modularity, openness and scalability.

Modularity allows various platform components of core technologies/solutions compatible to the independently developed component technologies/solutions. Thus, the patent strategy regarding patent portfolio development for the component technologies/solutions should include the patent outsourcing through patent acquisitions and M&A processes.

Openness provides the flexible and transparent interaction interface for the efficient and effective development of value-added applications by the value creators. Thus, the patent strategy should cover the open licensing program. Additionally, the patent strategy should provide the strong protections to the ecosystem collaborators.

Scalability is the application capability across several industries. Thus, the patent strategy for the patent creation, portfolio development and exploitation should take care of the relationship with the IoT ecosystem players across different industries. This means that the strategic patent creation, portfolio development and exploitation should consider not only the traditional Porter’s competition strategy but also the ecosystem alliance strategy across different industries.

Furthermore, the patent strategy should support the value creation by the platform provider itself. Following is an example of the patent strategy that can support the value creation by the platform provider itself by exploiting existing patents.

HBS Professor Iansiti, the author of “The Keystone Advantage,” suggested technological assimilation as a new engine for technological innovations in his article “Creative Construction.” In the technological assimilation frameworks, a core innovation that once provided stand-alone products or services for a specific market can be the building blocks for mass market generating innovations through assimilation to broader platforms that were not existed at the time of innovations. A good example may be the GPS technology providing LBS (location based services) applications for smartphones and automobiles. Another good example may be the DVR technology of TiVo that was integrated into digital set-top box platforms. By contrasting all possible value propositions from a IoT platform to the potential value proposition(s) provided by the inventive departure(s) (novelty point(s)) of the existing patent(s), the integration feasibility of the existing patented technologies into the platform can be found, and thus, the new integrated value propositions can be developed.

Forecasting & Strategy Development for Post-Smartphone (Wearables & IoT Devices) Patent Wars



As the smartphone market matured, many companies are looking for the post-smartphone market that can generate new revenues. Many market researchers expect that the interconnected IoT (Internet of Things) devices will create a new market that will result in more than $1 trillion in value added to the global economy within 10 years. In the short term, wearable computing devices are expected to form an early IoT market by interconnecting body-sensing devices and providing useful personal services including healthcare.

As we have seen in the smartphone market development, it is expected that the super-competition to preoccupy the leadership in the lucrative IoT market can lead to another round of patent wars. The post-smartphone patent wars, however, will be more extensive because of more extensive participation of players across several different industries. The post-smartphone patent wars will also be more complex because of the recent rapid change in legal environment and the learning curve from the smartphone patent wars. Therefore, more advanced and sophisticated patent strategy is required to prepare for the upcoming post-smartphone patent wars.
