Patent Litigation Risk Management: Mobile Telecommunications Case Study


Litigation risk management is one of key factors in strategic patent portfolio development. As a case study for a capability measure for litigation risk managemnt, litigation per patent is estimated for the US IPR holders in mobile telecommunications.

As of Oct. 15 2009, the key IPR holders and their IPR shares for mobile telecom were as follows:

Ericsson (3923), Nokia (3376), Motorola (3364), Samsung (2148), NEC (2061), Alcatel-Lucent (2013), Qualcomm (1997), MS (1884), Matsushita (1573), and IBM (1544).

For each IPR holders, patent lication cases are counted using Innography for the measure of the litigation per patent. The results were as follows:

Ericsson (0.01), Nokia (0.02), Motorola (0.05), Samsung (0.09), NEC (0.04), Alcatel-Lucent (0.06), Qualcomm (0.03), MS (0.11), Matsushita (0.07), and IBM (0.07).
