Alcatel-Lucent is committed to a framework for establishing predictable and more transparent maximum aggregate costs for licensing intellectual property rights (IPR) that relate to 3GPP Long Term Evolution and Service Architecture Evolution standards (LTE/SAE). Our commitment is intended to stimulate early adoption of mobile broadband technology across the communications and consumer electronic industries. The framework is based on the prevalent industry principle of fair, reasonable and nondiscriminatory (FRAND) licensing terms for standard essential patents. This means that we agree, subject to reciprocity, to reasonable, maximum aggregate royalty rates based on the inherent value of the technology in the end product and to flexible licensing arrangements according to Alcatel-Lucent’s proportional share of all standard essential IPR for the relevant product category.

The value added technology and patents are generated by the unrivalled technical and scientific expertise of the largest innovation powerhouse in the communications industry - Alcatel-Lucent’s Bell Labs which provides innovative technologies and solutions across the full spectrum of communications research. Alcatel-Lucent’s Bell Labs is a dynamic, cutting-edge research community with a robust foundation of technology milestones, boasting technical depth and breadth unrivaled in the communications industry. Presently, Alcatel-Lucent has over 26,000 active patents worldwide.

Alcatel-Lucent has a history of proven experience and innovations in the evolution, development and deployment of wireless technology such as CDMA and UMTS. This allows Alcatel-Lucent to understand the drivers, goals, and requirements for the technology direction of LTE. With a commitment to establish and support the definition and development of LTE, Alcatel-Lucent brings its understanding, innovations and expertise into industry standards.

Alcatel-Lucent is one of the industry leaders in technology input to LTE standards development and has a long history of providing industry leadership in the development of global wireless standards. Each year Alcatel-Lucent contributes a significant number of technical contributions to wireless standards bodies throughout the world. In particular, Alcatel-Lucent has made over 900 contributions to the progress of LTE during last 12 months on Radio Access Network issues, Core Network issues, and System Aspects. The quality of Alcatel-Lucent contributions is well recognized within the industry providing the foundation of many wireless standards.

With respect to LTE, Alcatel-Lucent will commit to license to any third party any of its LTE standard essential patents, to the extent of its ability to do so and subject to appropriate internal approvals, that are essential to an LTE standard promulgated by any industry or standards body in which Alcatel-Lucent actively participates under reasonable and nondiscriminatory terms negotiated between the parties (including terms for a grant back of licenses to Alcatel-Lucent).

Based on the current LTE landscape and to assist in the deployment of LTE infrastructures and consistent with the strength of Alcatel-Lucent technical innovations, we expect that we will license our LTE standard essential patent claims for handsets at a discounted royalty of no greater than 2%.
